When can a party be banned in Germany?

Why — for every option

  1. A — The cost of an election campaign is not grounds for a ban; the Party Act rather regulates transparency of funding.
  2. B — Correct: under Art. 21(2) of the Basic Law, the Federal Constitutional Court can ban a party that seeks to impair or abolish the free democratic basic order.
  3. C — Criticism of the head of state is covered by freedom of expression and is not grounds for a ban.
  4. D — New political ideas and manifestos are part of democratic competition and not grounds for a ban, as long as the free democratic basic order is not under attack.
